Sexual Harassment

October 10, 2008 |

Sexual harassment laws were originally developed for the purpose of ending mistreatment and discrimination against women in the workplace. Sadly, studies have shown that even today, 40-60% of women in the American workforce experience some kind of sexual harassment. And women are not alone.

Last year, 16% of the sexual harassment complaints filed with the U.S. Equal Employment Opportunity Commission were filed by men, mostly complaining about sexual harassment by female supervisors.

Since it was first developed, the notion of sexual harassment has expanded to include a wide range of inappropriate, offensive, and/or sexually-charged behavior in the workplace or a school. The unlawful conduct is not limited to heterosexual situations- same sex harassment, sexual orientation harassment and discrimination, gender harassment and discrimination, and pregnancy discrimination all come under the sexual harassment umbrella.

In fact, sexual harassment offenses are rarely about sex - they are about power... acts designed to humiliate, embarrass and control. It is normal for victims of harassment (which may include both the person being harassed and other employees who find the conduct offensive and disruptive), to feel ashamed, embarrassed and angry. Victims may feel forced to tolerate unwelcome and inappropriate conduct in order to keep their job - a result that can make the victim feel even more ashamed.

However, if you feel that your work or school environment is uncomfortable, intimidating, offensive, disrupted or virtually destroyed due to unwelcome and inappropriate conduct, you should consult an experienced sexual harassment attorney as soon as possible. If you tolerate the conduct for any period of time, a court may determine that you consented to it and perhaps even welcomed it. Moreover, while there are many places and ways for you to file a claim of harassment, there are strict timeframes that limit how long you have to file your claim.
